No obligation to seek suitable work elsewhere

If an employee who has reached the AOW age reports sick, the employer is not required to look for suitable employment with another employer. It is also not necessary to draw up an action plan or maintain a reintegration report. However, the employer is still required to support the employee’s return to work within their own organisation.

Employee still unfit for work after 13 weeks

If the employee is still unfit for work after 13 weeks, the employer is allowed to terminate the employment contract. If the employee has recovered but reports sick again within four weeks, both periods of absence are combined. In that case, the total period of continued salary payment remains capped at 13 weeks.
